Terms & Conditions

Last updated: October 2026. These terms govern your use of The Magic Shoes Adventure and THE CONTAINER (the "programs"), provided by RAE Performance Labs, operated by Brighton Ceasar ("the seller", "we", "us"). By using the programs you agree to these terms and contract with the seller.

Eligibility and accounts

Accounts are created by a parent or guardian who is of legal age and authorized to act for their family. Scholars use the programs under a grown-up's account. You are responsible for keeping your sign-in credentials confidential and for activity under your account, and for providing accurate information.

What the programs are — and are not

The programs are educational performance-development tools for young people. They are not therapy, counseling, diagnosis, medical or mental-health care, or a substitute for professional support. Nothing in the programs is clinical advice. Some situations — bullying, unsafe environments, accessibility needs, discrimination, or a lack of needed instruction — require a safe grown-up or qualified professional, and the programs say so explicitly where relevant.

License and acceptable use

We grant your family a limited, non-exclusive, non-transferable right to use the programs you have access to. You must not misuse the programs: no unlawful use, fraud or spam, infringing others' intellectual property, interfering with security (including malware, probing, or scraping), reverse engineering, reselling or redistributing access, or circumventing access controls.

Intellectual property

We retain ownership of the programs and their content, including stories, characters, illustrations, software, and branding. Scholars keep ownership of their own written reflections; you grant us a limited license to store and process that content solely to provide the programs.

Purchases, subscriptions, and Paddle

Paid access is sold as a one-time purchase or a monthly subscription, as shown on the pricing page. Monthly subscriptions renew each month until cancelled and can be cancelled at any time; access continues until the end of the paid period.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are also governed by Paddle's Buyer Terms.

Service level

We work to keep the programs available and improving, but we do not guarantee uninterrupted or error-free performance.

Suspension and termination

We may suspend or end access for material breach of these terms, non-payment, security or fraud risk, or repeated serious misuse. If access ends, you may contact us within a reasonable period to request an export of your family's data before it is deleted.

Warranties and liability

To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms limits liability for fraud, death, or personal injury where the law does not allow it.

General

These terms are governed by the laws of the seller's jurisdiction in the United States. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not responsible for delays caused by events beyond our reasonable control. If any part of these terms is unenforceable, the rest remains in effect.
